Doctor To Pay $42,500 To Settle Prescription Case

Civil settlement reached in claims of violations of the Controlled Substances Act

A West Hartford doctor will pay $42,500 to settle allegations that he wrote prescriptions that violated regulations under the Controlled Substances Act, David B. Fein, U.S. Attorney for Connecticut, announced Wednesday.

Dr. Murray Wellner, who practices internal medicine in West Hartford, agreed to a civil settlement of claims that he wrote 11 prescriptions for Vyvanase and Subutex  "outside the normal scope of his medical practice, in that these prescriptions were not dispensed to the individuals whose names were on the prescriptions," according to a press release from Fein's office.

Vyvanase is commonly prescribed to treat attention deficit disorder and Subutex to treat drug addiction.

In addition, according to the press release, Wellner faced allegations that he failed to "account for all of the controlled substances that he purchased and dispensed from his office."

The investigation was conducted by investigators from the Drug Enforcement Administration’s Office of Diversion Control in Rocky Hill, and the State of Connecticut, Department of Consumer Protection, Drug Control Division.  The prosecution was led by Assistant U.S. Attorney Alan M. Soloway.
